TERMS AND CONDITIONS OF SALE

A - Introduction

These conditions are valid exclusively between Nutripet of Luca Varani, with legal headquarters, operation office and warehouse located in via Abetone Brennero Nord, 15- 46035 Ostiglia (MN), VAT 02119530208, referred to as ''www.ORTHOPAEDIC4PET.com'', "Orthopaedic4pet" , "We"  or "us".

and a buyer, referred to as “CLIENT”. 

These conditions may be modified and they would be in force as of the issuing date on the website. 

These conditions rule any purchase completed on the website  www.Orthopaedic4pet.com, and they are pursuant to Part III, Title III, Section I, of the Italian Consumer Code (Codice del Consumo), Legislative Decree n. 206/2005, modified by Legislative Decree n. 21/2014 and by Legislative Decree 70/2003 on E-Commerce.

B - Acceptance of conditions of sale

  1. The contract between Orthopaedic4pet and the Client is concluded once Orthopaedic4pet accepts the order, in its entirety or in part. Orthopaedic4pet may or may not accept the order, at its uncontestable discretion.
    The acceptance is to be considered implicit if it is not communicated to the Client, with any mean. ACNOWLEDGEMENT OF ORDER (vedi dopo)
    By placing an order the Client accepts these Terms and Conditions in their entirety, included the Terms of Payment.
  2. If the Client is a consumer (that is, a person who purchases for purposes which can be regarded as outside his trade or profession), it is in his interest to print or save a copy of these Conditions once the purchase is concluded, as provided by articles 3 and 4 of Legislative Decree 185/1999 on distance sales.
  3. We will not be held liable in case we decide not to accept or just partially accept an order, causing a direct or indirect damage to things or persons. Every right of the Client to indemnity or compensation is excluded.

C – Manner of Purchase

  1. The Client can purchase only the products which are displayed on the www.Orthopaedic4pet.com e-commerce at the time of purchase, as they are described on the catalogue. Technical descriptions of the products displayed on the catalogue are the accurate reproduction of the specifications provided by the Producers.  Orthopaedic4pet may modify the technical descriptions to fit the new specifications provided by Producers, with no previous notice. It goes without saying that the pictures representing the product may not be the exact reproduction of that product and may be different per colors, dimensions and extra features. All the purchase support  information (Glossary, Purchase Guide etc...) are to be intended as general information which are not referred to any product in particular.
  2. Orthopaedic4pet acknowledges receipt of the order via e-mail, to the e-mail address provided by the Client. The receipt will contain date and hour when the order was received and a "Client order number", which will need to be quoted in case of further communications with us. The receipt contains all the Client's data and it's up to the Client to verify their correctness and promptly communicate every modification, with the modalities described as follows. At any time the Client can track the state of his order by accessing the dedicated web area "My Orders".
  3. In case Orthopaedic4pet decides not to accept the order, we will promptly acknowledge the Client.
  4. The Client can cancel the order at any time before it  reaches the warehouse to be processed. State of the order is visible in the dedicated web area "My Orders". The order cannot be cancelled when the wording "Order is being processed" appears.
  5. All the prices displayed on the website are VAT excluded. Orthopaedic4pet may decide to modify the prices, with no previous notice. In case we should mistakenly indicate a wrong price on the website (for technical or human glitches), the order will be cancelled, no matter if we had confirmed it.
  6. On the website  www.Orthopaedic4pet.com it is not possible to visualize the product quantity available at the time of the order. The availability of a certain product can be modified if many Clients access the website and order the product at the same time; therefore Orthopaedic4pet cannot guarantee the placement of every order.
  7. In case a product is subject to a discount, Orthopaedic4pet may decide to reduce the quantity ordered, by communicating it to the Client, who has to accept. In case the Client doesn't accept, the order is cancelled.

D - Terms of payment

  1. Paypal: If the Client choses to pay via Paypal, he will be redirected to the Paypal login page once the order is complete.
    The price of the order is charged on the Paypal account once the order is placed.
    If the order is cancelled, either because of the Client or because Orthopaedic4pet doesn't accept it, the amount paid will be refunded on the Paypal account of the Client.
    The Client can cancel the order at any time before it  reaches the warehouse to be processed. State of the order is visible in the dedicated web area "My Orders". The order cannot be cancelled when the wording "Order is being processed" appears.
    Once the Client has requested to cancel the order,  Orthopaedic4pet can't be held liable for  direct or indirect damage caused by any delay in the refund by Paypal. If the payment is placed via Paypal, Orthopaedic4pet is not able to see, at any time, private financial data belonging to the Client. For this reason, there is no chance that Client's private data is fished. Furthermore, Orthopaedic4pet doesn't process, neither store, this data. For each transaction placed via Paypal, the Client will receive a confirmation e-mail by Paypal.
  2. Credit cards: If the Client choses to pay via Credit Card, the order is placed when the online transaction is concluded.
    We accept Credit Cards belonging to the Visa, Mastercard and American Express circuits.
    If the transaction is made by using an American Express Card, the placement of the order may be delayed because this circuit may perform  controls against fraud. 
    Furthermore we remind you that the address where the products are delivered must be the one indicated when the Card has been issued. If this is not the case, the Client need to contact the American Express call center to authorize a different delivery address. 
    If the order has been cancelled, either because of the Client or because Orthopaedic4pet decided not to accept it, we will ask for the transaction to be cancelled. The Client can cancel the order at any time before it  reaches the warehouse to be processed. State of the order is visible in the dedicated web area "My Orders". The order cannot be cancelled when the wording "Order is being processed" appears.
    The times for refund, for some Credit Cards, depend exclusively on the Bank system and it may take up to 24 days from the authorization date to get the sum refunded.
    Once we have requested the cancellation of the transaction, we cannot be held liable for direct or indirect damages caused by any delay in the refund by the Bank.
    Orthopaedic4pet may ask the Client additional information (for instance, the landline number) or documents that can prove that he's the card holder. If these information are not provided on request, we may not accept the order.
    If the payment is placed via Credit Card Orthopaedic4pet is not able to see, at any time, private financial data belonging to the Client, because the transaction takes place on the bank's website – which is protected by elevate security measures; as no data is transmitted to us, there's no chance it is accidentally phished.  Furthermore, Orthopaedic4pet doesn't process, neither store, this data.  Orthopaedic4pet cannot be held liable in any case, for frauds concerning the unlawful use of the credit card from third parties, for products purchased on the www.Orthopaedic4pet.com.
  3. Bank transfer: If the Client choses to pay via Bank transfer, we will deliver the products once the sum has been credited to Nutripet – Luca Varani bank account. The sum needs to be credited within 8 working days from the date when the order has been accepted; after this deadline, the order is automatically cancelled. When paying via bank transfer, the Client must indicate, in the reason for payment field, the order number which we have sent in the confirmation e-mail. The bank number to which the payment should be wired is indicated in the confirmation e-mail too.

E - Use of Vouchers:

  1. A voucher can have a value ranging from ten Euros  (€ 10) up to one thousand Euros(€ 1000). Once a voucher has been purchased, we will deliver, to the e-mail address indicated by the Client, an activation code for using the voucher. The recipient needs to have a valid e-mail address and internet access.  Orthopaedic4pet can modify these conditions at its own dicretion and without warning.
  2. Manner of use
    1. A voucher doesn't expire.
    2. It cannot be divided into multiple payments.
    3. It cannot be transferred to third parties and it can be used exclusively to purchase products on the www. Orthopaedic4pet.com website. It cannot be monetized or used to purchase other vouchers.
    4. In case of purchases whose value is superior to the value of the Voucher, the Client will need to pay the remaining amount in order to complete the order, by choosing one of the available ways of payment.
    5. The withdrawal right is not applicable to the purchase of Vouchers. The right of withdrawal is guaranteed to the recipient of the Voucher, if the legal requirements apply.
    6. If the Voucher is used only partially, the remaining amount cannot be used and cannot be refunded.
    7. Orthopaedic4pet is not responsible if the voucher is stolen or used unlawfully.
    8. Orthopaedic4pet is not responsible if the Voucher activation code gets lost or is misused.
  3. Vouchers can be cumulated with other discounts displayed on our website or with other Vouchers. 

F - Security of transactions

Online transactions via Credit Card are performed on the Bank website, via a secure web server endowed with SSL (secure socket layer). This protocol, certified with Verisign, allows every communication to occur safely, in order to avoid phising, modification or falsification of the data transmitted.

We do not visualize the data of the Credit Cards used by our Clients. 

G - Delivery

Orthopaedic4pet delivers to Italy and everywhere in the world.

If the Client needs an order to be shipped to a troubled place, he needs to communicate it via e-mail. In this case, the cost of delivery could be different. 

Orthopaedic4pet does not deliver to mail boxes, post offices, and to companies providing address for services. 

For every order placed on www.Orthopaedic4pet.com, Orthopaedic4pet issues a receipt or invoice for the goods shipped. 

On the receipt or invoice, we will indicate the Client's data as provided at the time of the order. After an invoice/receipt has been issued, we cannot modify it. 

For each order which is equal or inferior to € 1000, we will issue a receipt. For the orders which are superior to € 1000, we will issue an invoice, indicating the Client's tax code. 

Shipping costs are to be born by the Client and are made clear before the order is placed. 

Shipping  costs can be subject to additional charges if particular conditions occur (delivery to suburbs, zones which are difficult to reach, or where the traffic is limited). The Client will pay the products and the delivery costs via the method he chose when placing the order. No other fees are due to Orthopaedic4pet.

Goods are considered to be shipped when they are taken in charge by the delivery service, where otherwhise not indicated. 

Goods are delivered in the boxes provided by the producer or into Orthopaedic4pet boxes, wrapped in protective clying film or into sealed envelopes.

Shipping times are approximate and they are indicated in the table under the voice "Approximate times of shipping" ; they can be subject to modifications in case of force majeure, critical traffic conditions, or as per decisions of an Authority. 

Standard shipping will take place: from 9.00 am to 1 pm; from 2 pm to 6 pm, every working day from Monday to Friday. 

Orthopaedic4pet takes no responsibility for any delay while processing the order or delivering  the goods. 

When the carrier delivers the products, the Client must check:

  1. That the number of the items is the same as indicated on the shipping note or the transport document;
  2. that the box is intact, not damaged, wet or tampered;

In case of visible damages or if the number of the items differs, the Client must notify it immediately to the carrier, and he must indicate "damaged", "open box" or "missing items" on the delivery paperwork. The Client should also report the fact promptly to Orthopaedic4pet via e-mail. 

Once he signs the paperwork, the Client cannot object to any visible damage of the product. 

If the box is intact, the goods need to be checked within 8 days from the date of acceptance of the delivery. Non visible damages or faults need to be reported via registered mail with return receipt to Orthopaedic4pet, to the address present on the delivery note. Furthermore the Client needs to file a "Record of fault" by  sending an email to info@orthopaedic4pet.com

Damages need to be reported by the deadline indicated above. The Client is responsible for what he declares. 

  1. Shipping with Express shipping
    Standard shipping will take place: from 9 am to 1 pm and from 2pm to 6pm each working day from Monday to Friday. At the first attempt, the carrier delivers without giving notice. If the Client is not reachable, the carrier leaves a notice of undelivered items and tries again within 24 hours; in case the Client can't be reached the carrier leaves another notice and the goods are stocked at the carrier's warehouse. The Client will be recontacted by Orthopaedic4pet or from the carrier itself with whom he will agree time and date of the delivery.
  2. Shipping with Economy carrier
    Standard shipping will take place: from 9 am to 1 pm and from 2pm to 6pm each working day from Monday to Friday.  At the first attempt, the carrier delivers without giving notice. If the Client is not reachable, the carrier leaves a notice of undelivered items and tries again within 24 hours; in case the Client can't be reached, the carrier leaves another notice the goods are stocked at the carrier's warehouse. The Client will be recontacted by Orthopaedic4pet or from the carrier itself with whom he will agree time and date of the delivery. 

H - Processing and shipping times

"processing time" is the number of business days we will take to handle the good to the carrier after receiving your order. Every order, if the products are available in the warehouse and if we got confirmation of payment within 12 pm of a working day, will be handled to the carrier within 24 hours (working days).

I - Shipping fees

Shipping fees for Economy/Express shipping

Shipping fees are determined on the basis of the items' weight and their destination. Client can visualize the fees by adding the items to the shopping basket, without proceeding to the purchase. 

All internationally shipped packages must clear customs in the destination country, and we send EVERY PARCEL WITH THE APPROPRIATE CUSTOM FORMS.

INTERNATIONAL BUYERS 

Please Note:

Import duties, taxes and charges are not included in the item price or shipping charges. These charges are the buyer’s responsibility.

Please check with your country’s customs office to determine what these additional costs will be prior to bidding/buying. 

These charges are normally collected by the delivering freight (shipping) company or when you pick the item up – do not confuse them for additional shipping charges.

L - Withdrawal right

  1. Pursuant to the rules of the Italian Consumer Code (Codice del Consumo), modified by Legislative Decree 21/2014, the Client who is a consumer (that is, a person who purchases for purposes which can be regarded as outside his trade or profession) has the right to withdraw from the contract, without giving any reason and without additional costs than the ones provided in section 3 in the following sections??, within 14 days from the day he receives the goods, or from the date the Client or a third party indicated by him acquires physical possession of the goods  Conditions and procedure for exercising the right of withdrawal are defined in the following sections.
  2. The Client who wants to excercise his right of withdrawal needs to communicate it to the e-mail address info@orthopaedic4pet.com
    Once we receive the e-mail, we will reply with a confirmation e-mail , acknowledging the Client's decision to withdraw. The Client has the right to ask for  a carrier of is own choice for returning the goods, as long as the items are assigned a track number. On the custom declaration (if necessary) the Client must indicate "other reasons: items returned".
    The Cliest must bear the shipping costs for returning the goods. 
    In case we are charged with additional fees for receiving the item (customs etc...), will be detracted from the amount we owe to the Client. 

    Orthopaedic4pet may detract the 30% of the product price from the amount to refund in case the product is returned in bad conditions ( spoiled, dirty). 

  3. Once the above mentioned procedure has been followed, the Client has to return the goods, carefully wrapped into their original packages exclusively to:

  4. The Client must return the goods not later than 14 days after having informed Orthopaedic4pet about his decision to withdraw from the contract.
    Orthopaedic4pet, pursuant of art.56 of the Legislative Decree 21/2014, once verified that the conditions provided for in section 2  above mentioned apply , will refund the Client of the product price, within 14 days from the communication of the decision to withdraw. We may decide to postpone the refund until we receive the product, or until the Client provides evidence of having  delivered and handled the products to the Carrier. Refund will take place through the same modalities used by the Client for the purchase or, if expressely asked, via bank transfer, or refund on the Credit Card or Paypal account.

  5. The Client loses his right to withdraw in case the product has been returned withouth the original wrapping, the documents or the original box; or in case the product misses some of the accessories or its constitutive parts; or in case the product is damaged or is returned in an unsuitable state; and in general, if conditions provided for in section 4  are not respected.
    If the Client loses his right of withdrawal, he will not be refunded and Orthopaedic4pet will return his product. 

M – Renouncing the purchase

The Client can refuse to pick up the products from the Carrier. However, when refunding the price,  we will deduct the shipping fees paid for delivering the product to the Client and for returning it to us. We will refund only the product price, without the shipping costs to and from the Client address. 

N - Personal data protection 

Personal data collected by Orthopaedic4pet to  are stored safely on our IT system in order to process and complete the order. We will never, in any case, share your data with third parties.

Orthopaedic4pet guarantees to be pursuant of the Italian Personal data protection rules,  Legislative decree 196/2003 (Codice della Privacy).

Data controller is the legal representative of Nutripet of Luca Varani,  Via Abetone Brennero Nord, 15 -46035 Ostiglia (MN) Italy – unless a data processor is appointed, as per article 29, legislative decree 196/2003. 

The Client has the right to ask for the deletion, blocking or erasing of the data, via a written request to send via e-mail to  Info@Orthopaedic4pet.com

declaring that he has being informed of his rights as per art. 13 and 7 of legislative decree 196/2003 and has the right to access his data. 

We can send marketing communications only if the Client explicitly agrees, by registering on the form online and authorizing us to process his data for delivering marketing e-mails.

P - Conditions

Orthopaedic4pet may modify these terms and conditions without previous notice. This conditions are valid as of the issuing date on our website. 

Q - EXCEPTION SELLER

Some of our products, in ORTHOPAEDIC4 PET catalog, could have the limitations import in some countries.
We send worldwide and we can't know all of limitations.
Therefore, before buy, we invite of verify c/o yours country's Authority if exist restrictions on these products.
